Court prohibits VIO from seizing vehicles

Justice Evelyn Maha of the Federal High Court in Abuja has issued a ruling that stops the Vehicle Inspection Office (VIO) from stopping, impounding, or seizing vehicles on the road.

The court also ruled that the VIO could no longer fine motorists for violations.

This decision, delivered by Justice Maha on October 2, came after human rights activist and lawyer Abubakar Marshal filed a case arguing that these actions violated the rights of drivers.

In her judgment, Justice Maha agreed with Marshal, stating that the VIO had no legal grounds to stop or seize vehicles or impose fines on motorists.

The case, with the reference FHC/ABJ/CS/1695/2023, was filed against several parties, including the VIO, its Director, Mr. Leo, the Area Commander for December 2023, Onoja Solomon, and the Minister of the Federal Capital Territory.

Marshal argued that the actions of these officials violated the Nigerian Constitution, which guarantees freedom of movement and the right to fair hearing.

The court concluded by issuing an order that prevents the VIO and related authorities from impounding vehicles or issuing fines, deeming such practices unlawful and oppressive.
