Court of Appeal Holds Decision on Appeals Involving Benue APC Chairmanship and Former Local Government Chairmen
The Court of Appeal in Makurdi has reviewed an appeal by Hon. Moses Agaba, challenging a decision that overturned an order preventing Comrade Austin Agada from functioning as Benue State APC Chairman.
Agaba’s attorney, Matthew Burkaa, SAN, claimed the Chief Judge of the State High Court overstepped by taking the case from another judge and nullifying the restraining order, effectively reviewing an equal-level judge’s decision.
Agada’s lawyer, Yakubu Philemon, SAN, argued the order expired in February 2024 and wasn’t renewed, supporting the Chief Judge’s action.
The court also heard an appeal involving 23 former Benue Local Government Chairmen disputing their dismissal, with arguments centering on the National Industrial Court’s jurisdiction over the case. The Court of Appeal reserved its decisions for both cases, to be delivered at a later time.
