BREAKING: Appeal Court Removes Enugu Rep Member, Declares Labour Party Candidate as Winner

The Court of Appeal sitting in Enugu has upheld the removal of Hon. Simon Atigwe of the Peoples Democratic Party (PDP) from the House of Representatives, following a decision by the Election Petition Tribunal.The court confirmed Hon. Dennis Nnamdi Agbo of the Labour Party (LP) as the rightful winner of the February 3, 2024, re-run election for the Igbo-Eze North/Udenu Federal.
The unanimous judgement was delivered by the three-member panel, with Justice Ekanem reading the decision on behalf of the court.One of the lawyers representing the Labour Party, Ifeanyi Ogenyi, celebrated the verdict in a post on Wednesday.
He congratulated the people of the Igbo-Eze North/Udenu Federal Constituency and noted that while justice may be slow, the truth eventually prevailed. “Dennis Agbo has prevailed!” he wrote.Initially, the Independent National Electoral Commission (INEC) had declared Atigwe the winner of the re-run election.
However, Agbo, who had previously won the February 25, 2023, election but was later removed by the appellate court, contested Atigwe’s victory at the tribunal.
Agbo won both at the tribunal and the Appeal Court, confirming his rightful place as the elected representative.
